What is ITAR?

ITAR, or the International Traffic in Arms Regulations, isa set of regulations established by the U.S. Department of State. ITAR governs the export and import of specific commodities, defense-related articles and services on the United States Munitions List (USML), and technical data. This includes firearms, ammunition, explosives, spacecraft, specialized military technologies, and military-grade equipment. The goal is to control access to sensitive goods, technologies and their associated data to ensure safety and security.

A company is subject to ITAR if they ship or transmit items or technical data that has been designed, developed, adapted, or modified for military use under the USML.

ITAR and International Trade

ITAR limits access to USML goods and services to U.S. citizens, which has implications for international trade. However, some countries (Canada, Australia, and the UK) have standing agreements with the U.S. that apply to ITAR. Under these agreements, some of the licensing requirements for international trade have been relaxed. Exporters should still ensure that all their activities comply with ITAR, as non-compliance can result in heavy fines, criminal charges, and loss of export privileges.

What is ITAR Registration?

ITAR registration is a formal process by which companies register with the U.S. Department of State's Directorate of Defense Trade Controls (DDTC). The DDTC oversees and enforces ITAR compliance. Being ITAR registered is a legal requirement for businesses and organizations engaged in defense-related activities. Key industries requiring ITAR compliance include aerospace and defense companies. However, ITAR may also apply to companies designing and manufacturing military-grade electronics and equipment, universities and research institutions, IT companies, and software or hardware providers.
